Georgia Trump Supporter Seeks Legal Action Against Fani Willis

A Georgia Trump supporter named Brad Barnes is attempting to use an obscure law to have Fulton County District Attorney Fani Willis arrested for her office’s pursuit of charges against former President Donald Trump related to his alleged efforts to overturn the 2020 election results in Georgia. Barnes, who previously ran unsuccessfully for the Georgia House of Representatives, is filing an application for a warrant to arrest Willis on charges such as violation of oath by a public officer and unprofessional conduct by a public officer under Georgia state law, as well as federal charges of conspiracy against rights and deprivation of rights under the color of law.

Barnes alleges that Willis is using her public office to settle a political grudge, claiming that charging individuals for their legal actions, including representing clients and filing legal paperwork, violates their First Amendment right to redress of grievances. However, Georgia state law imposes a high threshold for obtaining an arrest warrant. To do so, an individual must first file a police report and then go through a legal hearing process where a judge evaluates whether there is justifiable cause for the arrest. Arrest warrants in Georgia are not issued to “teach someone a lesson” but are based on evidence of criminal acts. Furthermore, any warrant for the arrest of a public officer for offenses allegedly committed while performing their duties can only be issued by specific judges.

Barnes’ ability to have Willis arrested is uncertain, and it’s unclear whether he has the standing to pursue such action.
